1. Introduction
These Terms of Service ("Terms") govern your access to and use of the Struqt platform at struqt.co.za ("Struqt", "we", "us"). By creating an account or using the platform, you agree to these Terms and our Privacy Policy.
2. The Platform
Struqt is a construction procurement platform that helps contractors and subcontractors issue requests for quotation (RFQs), compare bids, award work, and manage contracts. Struqt is a facilitation platform — we are not a party to contracts awarded between users.
3. Accounts
You must provide accurate company and contact information. You are responsible for maintaining the security of your account credentials and for all activity under your account. Struqt may suspend or terminate accounts that violate these Terms or misuse the platform.
4. Fees
Struqt charges a success fee to the winning bidder when a contract is awarded through the platform. There is no subscription fee and no charge to browse or submit bids. The applicable fee is calculated on the VAT-exclusive award value using the marginal tiered schedule in Schedule A below. Fees are capped at R100,000 per award.
Payment is due upon award. During the pilot phase, invoices may be settled by bank transfer (EFT) as instructed on your invoice. Online payment gateway integration may be introduced at a later date.
5. User Conduct
You agree not to misuse the platform, submit fraudulent bids, misrepresent qualifications or compliance documents, or attempt to circumvent Struqt fees by completing awarded work off-platform without disclosure.
6. Limitation of Liability
Struqt provides the platform "as is". We do not guarantee bid quality, contractor performance, or project outcomes. To the fullest extent permitted by law, Struqt's liability is limited to fees paid to us in the twelve months preceding any claim.
7. Governing Law
These Terms are governed by the laws of the Republic of South Africa. Disputes shall be subject to the exclusive jurisdiction of South African courts.
Schedule A — Success Fee Table
Marginal tiered rate on the VAT-exclusive award value. Each band is charged at its own rate and summed — not one flat rate on the full amount. Awards of R25,000 or less incur no fee.

Total fee capped at R100 000 per award. Example: R500 000 → fee R12 500 (2.5% effective).
